What is a Responsible Person — and why do you need one?

Since 13 December 2024, the EU's General Product Safety Regulation (GPSR - Regulation EU 2023/988) requires every consumer product placed on the EU market to have a designated Responsible Person (RP) established within the EU. The equivalent obligation applies in the UKunder the UK GPSR framework for Great Britain.

If your business is based outside the EU or UK, you cannot fulfil the RP role yourself. Without appointing one, your products cannot legally be placed on either market - and non-compliance risks product seizure, market bans, and significant fines.

GPSR came into force on 13 December 2024. It is the most significant update to European product safety law in over two decades, replacing the previous General Product Safety Directive. All consumer products sold in the EU - including via online marketplaces such as Amazon - must now have a compliant Responsible Person in place.
  • Applies to all consumer products - electronics, cosmetics, toys, furniture, clothing, household goods, and more
  • The RP's name and address must appear visibly on the product, its packaging, or accompanying documentation
  • Online marketplaces (Amazon, eBay, etc.) are now required to verify that sellers have a properly appointed RP for regulated products
  • The RP must cooperate with market surveillance authorities and provide relevant technical documentation on request
  • Failure to appoint an RP can result in products being withdrawn from sale or recalled from the market

UK Responsible Person

UK GPSR - Great Britain market
  • Required for all non-UK established businesses selling into England, Scotland, and Wales
  • UK GPSR framework effective from December 2024
  • RP address must appear on product or packaging
  • UKCA marking support available for regulated product categories
  • Liaison with the Office for Product Safety and Standards (OPSS) and Trading Standards
  • Separate obligations apply to Northern Ireland under EU GPSR

EU Responsible Person

EU GPSR (Reg. 2023/988) - all 27 member states
  • Required for all non-EU established manufacturers selling directly into the EU
  • Applies to direct sales, online marketplaces, and fulfilment providers
  • RP address must be clearly visible on product, packaging, or documentation
  • CE marking support available for harmonised product categories
  • Cooperation with EU market surveillance authorities as required by Article 16 GPSR
  • Covers B2C and B2B products reasonably foreseeable for consumer use
